Terry Nagy, former executive vice president of Infinium Labs, is suing the company and its principal officers for fraud and breach of contract. Nagy claims that the company used him and his knowledge of the video games industry, while promising him a big payoff in shares of company stock – which he claims he never received. Nagy claims that in the autumn of 2003, Infinium Labs cancelled his e-mail and telephone service, and executives Timothy M. Roberts and Robert Shambro stopped returning his calls.
