The lawsuit, filed last week in federal court in eastern New York, claims that Acclaim used the biker's name and likeness to promote the game after both parties agreed that he would not be associated with the game. Mirra contends that Acclaim talked to him last March about using his name in BMX XXX, and he agreed to be part of the game based on early concepts of it. However, when the direction of the game turned pornographic, Mirra reversed his earlier decision. Mirra's suit claims that in July 2002, a second agreement was made with Acclaim to remove his name and likeness from the game and its promotional materials -- but that Acclaim did not live up to that agreement. Acclaim says it will fight the lawsuit. The news came to light after the stock market closed today, so any impact on Acclaim shares will be seen Tuesday morning. Acclaim shares closed at 56 cents today.
