Jonathan Sacks, CEO and President of mobile game and portal developer MForma, has issued a statement regarding the lawsuit filed against his company by Internet portal Yahoo!, even as a California judge filed a temporary restraining order prohibiting MForma employees from using allegedly proprietary Yahoo! secrets. The suit, filed on the 1st, alleges that seven former Yahoo! employees now working at MForma are using trade secrets developed at Yahoo! in their work at the mobile game creator. "We are very disappointed that Yahoo! chose to use litigation against our small company as well as its own former engineers to punish and intimidate," said Sacks. "While we understand it's always unpleasant to lose talent, Yahoo! has gone too far in wrongfully accusing us of a conspiracy that doesn't exist." "If they are having problems retaining engineers," continued the MForma CEO, "they should be looking at the internal sources of employee dissatisfaction rather than trying to cover that up with this legal action. The six ex-Yahoo mobile software engineers will continue working for us and MForma will comply with the court's order." San Francisco-based MForma itself is a publisher of cell phone games including Call Of Duty 2, True Crime: Streets of LA, Monopoly Tycoon and Elder Scrolls Travels: Stormhold, and also develops branded WAP portals including Billboard Mobile and Marvel Mobile.
